For anything relating to your personal data, write to us at presidencia@asisteya.com.
2. What data we collect

3. Sensitive data
To carry out a repatriation we need to process information about a person’s death and, in some cases, its cause or their prior state of health. This is sensitive data under Article 5 of Colombia’s Law 1581 of 2012 and under equivalent rules in other jurisdictions.
We process it only where it is strictly necessary to deliver the service you contracted, where a consular, health or airport authority requires it, or where the data subject or their representative has given express authorisation.
You are not obliged to authorise the processing of sensitive data. Without that authorisation, however, we cannot carry out the repatriation, because consulates, health authorities and airlines require that documentation.
4. Why we use your data
| Purpose | Legal basis |
|---|---|
| Answering enquiries and requests for information | Consent |
| Managing your membership and collecting the monthly fee | Performance of the contract |
| Carrying out the repatriation and its formalities | Performance of the contract |
| Submitting documents to consulates, health authorities and airlines | Legal obligation and performance of the contract |
| Invoicing and accounting | Legal obligation |
| Sending commercial communications and the newsletter | Consent, withdrawable at any time |
| Fraud prevention and platform security | Legitimate interest |
| Responding to requests from public authorities | Legal obligation |
5. Who we share your data with
We share data only with those who need it to deliver the service:
- Consulates and embassies of the country of origin and of the country where the death occurred.
- Health and customs authorities in both countries.
- Airlines and air cargo agents.
- Authorised preparation and embalming facilities.
- Partner funeral homes in the destination country, where the plan provides for it.
- Sworn translators and apostille services.
- Technology providers: web hosting, email, payment gateway and analytics tools.
- Judicial or administrative authorities, where legally required.
We do not sell your personal data and we do not share it for advertising purposes unrelated to AsisteYa.
6. International transfers
Because of the nature of the service, your data moves between countries. Our servers and providers are located mainly in the United States.
If you are a data subject in Colombia, note that the Superintendencia de Industria y Comercio has not declared the United States a country with an adequate level of protection. The transfer is made under Article 26(a) of Law 1581 of 2012, covering transfers expressly authorised by the data subject. By accepting this policy and contracting the service, you expressly authorise that transfer.
7. How long we keep your data
- Enquiries that do not lead to a contract: 24 months from the last contact.
- Member data: for the life of the plan and 10 years afterwards, for accounting and tax obligations.
- Documentation from a completed repatriation: 10 years, as it carries legal and health effects.
- Marketing data: until you withdraw consent.
Once those periods elapse, data is deleted or irreversibly anonymised.
8. Your rights
If you are in Colombia (Law 1581 of 2012)
You have the right to access, update, rectify and delete your data; to request proof of the authorisation you gave; to be told how your data has been used; to withdraw your authorisation; and to complain to the Superintendencia de Industria y Comercio.
To exercise these rights, write to presidencia@asisteya.com stating your name, your identity document and your specific request. Enquiries are answered within 10 working days, extendable by a further 5. Complaints are answered within 15 working days, extendable by a further 8.
Under Article 16 of Law 1581 of 2012, you must raise your enquiry or complaint with us before going to the Superintendencia.
If you are in the United States
Depending on your state of residence, you may have the right to know what data we hold about you, to request its deletion, to correct it and not to be discriminated against for exercising these rights. California residents may exercise their CCPA and CPRA rights by writing to presidencia@asisteya.com. AsisteYa does not sell or share personal data as those terms are defined in that legislation.
If you are in the European Economic Area or the United Kingdom
You have the rights of access, rectification, erasure, restriction of processing, portability and objection, and you may lodge a complaint with the supervisory authority in your country.
9. Children
This site is not directed at children and we do not knowingly collect their data. Where a minor is named as a beneficiary of a plan, their data is supplied by their legal representative, who is responsible for that authorisation.
10. Security
We apply reasonable technical and organisational measures: encryption in transit over HTTPS, role-based access control, regular backups and confidentiality agreements with our staff and providers. No system is infallible; if an incident affects your data we will notify you and report it to the authorities where the law requires.
11. Changes to this policy
We may update this policy. The version in force is always the one published on this site, with its update date. If a change is substantial we will notify you by email.
